The new Companies Act (“the Act”) creates a clear distinction between people who are not eligible to become directors and those who are disqualified from becoming directors. Ineligibility means that a person is prohibited from becoming a director. Disqualification arises where the person was legally permitted to become a director, but due to their misconduct, they are no longer allowed to be a director in any company.

Q: I desperately want to divorce my husband as I cannot bear to live with him any longer. Our relationship has broken down and he has absolutely no respect for me. I need to get out of this nightmare but I don’t have the money to be able afford an attorney.
I stopped working when our children were born so I am completely dependent on my husband for money. I am also scared that my husband will stop paying any money to me and our children for our monthly expenses. Is there any kind of a solution for this? I am sure many other people have also found themselves in the same position.
